Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Estate Ledger ("we", "us", "our"), governing your use of the Estate Ledger platform, website, and related services (collectively, the "Service").
By accessing or using Estate Ledger, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with these Terms.
Description of Service
Estate Ledger is a property management software platform designed to help Canadian landlords and property investors organize rental income, track expenses, manage tenants, and prepare data for tax reporting purposes.
Your Account
To use Estate Ledger you must create an account with a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access at [email protected]
You may not share your account credentials with others or create accounts for unauthorized third parties.
Free Trial & Subscription
Free Trial
Estate Ledger offers a 90-day free trial with full access to all features. No credit card is required to start a free trial. At the end of the trial period, you may choose to subscribe to continue using the Service.
Subscription
- Subscriptions are billed monthly at the rate displayed at time of purchase
- Payment is processed securely via Stripe
- Subscriptions renew automatically unless cancelled before the renewal date
- You may cancel your subscription at any time from your account settings
- No refunds are provided for partial months
Price Changes
We reserve the right to change subscription pricing. We will provide at least 30 days notice before any price change takes effect for existing subscribers.
Acceptable Use
You agree to use Estate Ledger only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Upload or store data that infringes on any third party's privacy or intellectual property rights
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to store or transmit malicious code
- Resell or sublicense access to the Service without written permission
- Use automated scripts or bots to interact with the Service
Your Data
You retain full ownership of all data you enter into Estate Ledger. By using the Service, you grant us a limited license to store and process your data solely for the purpose of providing the Service to you.
We will not access your data except as necessary to provide support, maintain the Service, or as required by law.
Upon account termination, you may export your data. After 30 days from termination, we may delete your data from our servers. We are not responsible for any data loss resulting from account termination.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure at all times
- Any errors will be corrected
- The Service is free of viruses or other harmful components
- Results obtained from the Service will be accurate or reliable for tax or legal purposes
Mortgage calculations are estimates based on standard Canadian semi-annual compounding and may differ from your lender's actual calculations. Always verify with your lender.
CRA line numbers and tax categories reflect Canadian tax rules as understood at the time of development and may not reflect current CRA regulations. Always file with professional guidance.
Limitation of Liability
To the fullest extent permitted by applicable law, Estate Ledger and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use the Service
- Errors or inaccuracies in data generated by the Service
- Tax penalties, audit findings, or CRA disputes arising from use of the Service
- Loss of data or unauthorized access to your account
- Any other matter relating to the Service
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months prior to the claim.
Termination
You may cancel your account at any time from your account settings or by contacting us. We may suspend or terminate your access to the Service immediately if:
- You violate these Terms
- Your subscription payment fails and is not resolved within 7 days
- We are required to do so by law
Upon termination, your right to use the Service ceases immediately. Sections 07 (Disclaimers) and 08 (Limitation of Liability) survive termination.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved in the courts of British Columbia, Canada.
Changes to Terms
We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify registered users by email at least 14 days before the changes take effect.
Continued use of the Service after updated Terms take effect constitutes your acceptance of the new Terms.
